These General Terms of Use (the "GTU") define the conditions under which users (the "Users") are authorised to access and use the services of the online store boutique.parisbasketball.com/fr/ (the "Site"). The GTU are not intended to govern any commercial relationship between ORECA and the User.
By accessing, browsing and/or using the Site, the User unconditionally accepts these GTU. ORECA reserves the right to modify the GTU at any time and without prior notice by publishing a new version on the Site.

AVAILABILITY AND ACCESS TO THE SITE
The Site is in principle accessible 24/7, except for interruptions, scheduled or otherwise, for maintenance purposes or cases of force majeure.
ORECA endeavours to ensure, to the best of its ability, the accuracy and currency of the information published on the Site, which it reserves the right to correct at any time and without notice. However, ORECA accepts no liability for any interruption, bug, inaccuracy or omission relating to information available on the Site, damage resulting from fraudulent third-party intrusion leading to modification of information made available on the Site, or more generally any direct or indirect damage.
ORECA may at any time temporarily or permanently restrict or suspend a User's access to the Site in the event of a breach of the GTU, without prejudice to any other rights in favour of ORECA.
In the event of permanent discontinuation, the User agrees to immediately destroy any copy of the Site and/or its content.
ACCOUNT CREATION
In order to make full use of the Site's features, the User may create a customer account (the "Account") via an online form provided for this purpose. For clarification, in order to make a purchase on the Site, the User must create an account. The information provided by the User must be accurate, complete and up to date. The User agrees not to create an account with identifiers that are manifestly or potentially offensive, controversial, disparaging, contrary to public policy or morality, or likely to cause controversy. The User is free to modify and/or update the personal data they initially provided. Upon confirmation of account creation, the account is valid for an indefinite period. The User may request deletion at any time, without specific reason, by simple notification to support@parisbasketballhelp.zendesk.com. Conversely, ORECA may deactivate the account in the event of inactivity for more than 3 (three) years and/or in the event of the User's breach of the GTU.
HYPERLINKS
The Site may include links to other websites or internet sources. As ORECA cannot control these external sites and sources, ORECA cannot be held responsible for the availability of these external sites and sources, and accepts no liability for their content. Accordingly, access to external sites and sources is at the User's own risk.
The creation of hyperlinks to the Site may only be made with ORECA's prior written authorisation. ORECA is therefore not responsible for hyperlinks pointing to the Site.
REPORTING UNLAWFUL CONTENT

The sources of information published on the Site are considered reliable, but the Site does not guarantee that it is free from defects, errors or omissions. ORECA gives no warranty, express or implied, and assumes no responsibility for the use and interpretation of this information, the content and services of the Site, which the User expressly acknowledges. Despite regular updates, the Site cannot be held responsible for changes in administrative and legal provisions occurring after publication.
Access to the products and services presented on the Site may be subject to restrictions. You must therefore ensure that the law of the country from which you are connecting authorises you to access the Site.

INTELLECTUAL PROPERTY
The Site is the exclusive property of ORECA.
The Site constitutes a work of which Maison Transversale is the author within the meaning of Articles L111-1 et seq. of the French Intellectual Property Code. The design and development of the Site were carried out by Maison Transversale.
The general structure, texts, images, photographs, sounds, graphics, drawings, slogans, animated sequences (with or without sound) and any other elements making up the Site are the exclusive property of ORECA, third parties who have assigned their rights to ORECA, or third parties who have authorised ORECA to use them. Accordingly, it is prohibited to copy, modify, create derivative works from, sell, assign, sublicense or transfer any rights relating to the software and/or the Site.
The trademarks, logos and other intellectual property rights cited on the Site are registered trademarks. Any total or partial reproduction or representation, modification or alteration of these trademarks, logos or any documents published on the Site, without the express authorisation of ORECA or their owners, is prohibited under Article L. 713-2 of the French Intellectual Property Code and would constitute an infringement sanctioned by Articles L. 335-2 et seq. of the French Intellectual Property Code.

ORECA and Paris Basketball, as joint data controllers, may collect personal data under the conditions and for the purposes set out in the personal data protection policy.

ORECA reserves the right to modify and update, at any time and without notice, access to the Site and the GTU. Such modifications and updates are binding on the User upon publication on the Site.
APPLICABLE LAW AND JURISDICTION
French law applies to these GTU. In the absence of an amicable resolution of any dispute relating to the use of the Site, the Toulon court shall have territorial jurisdiction.
